Terms of Service

These Terms govern your use of the HALA MOVE platform. They set out what HALA MOVE is, what it is not, and the rights and obligations of everyone who uses it.

Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the HALA MOVE platform, including the HALA MOVE website at halaapp.co.za and the HALA MOVE mobile applications (collectively, “the Platform”). The Platform is operated by HALA MOVE (Pty) Ltd, a company registered in the Republic of South Africa (“HALA MOVE”, “we”, “us”, “our”).

By accessing or using the Platform, downloading either of our mobile applications, creating an account, or completing any transaction through the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

These Terms are effective as of the date on which you first access or use the Platform. If you are registering on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

Definitions

In these Terms, the following words have the following meanings:

  • Platform: The HALA website, mobile applications, and all related services operated by HALA MOVE (Pty) Ltd.
  • User: Any person who accesses or uses the Platform in any capacity.
  • Customer: A User who registers to post jobs and engage transport services through the Platform.
  • Driver: An independent service provider registered on the Platform to bid for and complete transport jobs.
  • Fleet Owner: A User who operates two or more registered vehicles and manages multiple drivers through a fleet account on the Platform.
  • Job: A request for transport services posted by a Customer on the Platform.
  • Bid: An offer submitted by a Driver to complete a specific Job at a stated price.
  • Escrow: The mechanism by which a Customer’s payment is held securely by PayFast following Bid acceptance and released to the Driver only upon confirmed delivery.
  • Driver Payout: The amount payable to the Driver upon Job completion, equal to 80% of the accepted Bid amount.
  • Platform Fee: HALA MOVE’s 20% share of the accepted Bid amount, retained from the total payment as consideration for providing the Platform.
  • B2B Contract: A formal, multi-job contract between HALA MOVE and a corporate client under which Jobs are allocated to Fleet Owners.
  • Account: A registered User profile on the Platform.
  • Verified Driver: A Driver who has successfully completed HALA MOVE’s Driver registration verification process set out in Clause 4. The word “Verified” in HALA MOVE’s platform and marketing communications refers exclusively to the checks completed at the time of registration. It is not a representation that a Driver’s conduct, health, criminal record, legal status, or vehicle condition has been assessed on a continuous or ongoing basis after the date of initial verification.

Nature of the Platform

This section is the most legally significant part of these Terms. Please read it carefully.

HALA MOVE is a technology platform. HALA MOVE facilitates transactions between Customers who need transport services and independent Drivers who provide those services. HALA MOVE is not a party to the transport service transaction itself.

Specifically:

  • HALA MOVE does not employ Drivers. Drivers are independent service providers who set their own hours, choose which Jobs to bid on, and operate their own vehicles.
  • HALA MOVE does not own or operate any vehicles. All vehicles used to complete Jobs are owned or operated by registered Drivers.
  • HALA MOVE is not a transport company, courier company, freight operator, or logistics company as defined under South African law, including under the National Road Traffic Act and applicable transport legislation.
  • The transport services contract is between the Customer and the Driver. HALA MOVE is not a party to that contract.
  • HALA MOVE does not guarantee that any specific Job will be completed, that any specific Driver will appear, or that any specific service standard will be met. HALA MOVE operates on a best-efforts basis to facilitate reliable connections between Customers and verified Drivers.

Account Registration & Verification

To use the Platform, you must create an Account. You must provide accurate, current, and complete information during registration and keep this information updated.

You are responsible for maintaining the confidentiality of your Account and for all activity that occurs under it. You must notify HALA MOVE immediately at hello@halaapp.co.za if you become aware of any unauthorised use of your Account.

What “Verified” means

HALA MOVE’s driver verification process checks the following at the time of registration:

  • South African ID document — verified against the Department of Home Affairs database
  • Valid driver’s licence — confirmed as current and issued for the relevant vehicle code
  • Vehicle registration certificate — confirms the vehicle is legally registered in the Republic of South Africa
  • Roadworthy certificate — confirms vehicle roadworthiness at the time the certificate was issued
  • Bank account — confirmed as active for payout processing

Verification is a condition of Driver Account activation. These checks are performed once, at the time of registration. HALA MOVE does not conduct continuous or periodic re-verification of a Driver’s licence, vehicle roadworthy status, criminal record, or legal standing after initial approval. When HALA MOVE refers to “Verified Drivers” on the platform, website, or in any marketing materials, this refers to Drivers who have completed the registration verification process described in this clause.

HALA MOVE reserves the right to refuse, revoke, or suspend verification at its discretion. A Driver whose verification is suspended will not appear as available on the Platform until the suspension is resolved.

HALA MOVE may suspend or terminate any Account that provides false, misleading, or inaccurate registration information without prior notice.

Customer Terms

Job descriptions

When posting a Job, you must provide accurate and complete information about the items to be transported, the pickup and dropoff locations, the floor level at each location, whether a lift is available, and any special handling requirements. Providing inaccurate information may result in additional charges, Driver refusal to proceed, or Job cancellation. HALA MOVE is not liable for delays or cost differences that result from inaccurate Customer-provided information.

Payment

By accepting a Driver’s Bid, you authorise HALA MOVE to hold the Bid amount in Escrow through PayFast. This payment hold is confirmed before the Driver is dispatched. Payment is released from Escrow to the Driver only when you confirm delivery in the HALA MOVE Customer app. You must confirm delivery promptly following receipt of your items. If you unreasonably withhold delivery confirmation, HALA MOVE may release payment to the Driver following investigation.

Photo protocol at pickup

Before your Driver loads any items, they will photograph your items and you will be asked to review and approve these photographs in the app. By approving, you acknowledge the pre-loading condition of your items as documented. This acknowledgment is significant in any subsequent damage dispute.

Cancellation

You may cancel a Job at no charge before a Driver accepts your posting. If you cancel after a Driver has accepted your Bid and has already been dispatched, a cancellation fee may apply to compensate the Driver for fuel and time already committed. The applicable cancellation fee will be shown to you before you confirm cancellation. Your payment hold will be released within 24 hours of cancellation in all cases.

Driver Terms

Driver obligations are set out fully in the Driver Agreement, which forms part of these Terms and is incorporated by reference. By using the Platform as a Driver, you accept both these Terms and the Driver Agreement.

Key Driver obligations include: maintaining a valid roadworthy certificate, following the mandatory photo protocol on every job, maintaining the required completion and rating thresholds, and not engaging in off-platform transactions with Customers.

Platform Fees & Payments

HALA MOVE charges a Platform Fee of 20% of the accepted Bid amount for each completed consumer Job. The Driver receives 80% of the accepted Bid amount as the Driver Payout. This split applies to all consumer Jobs.

B2B contract pricing is separately negotiated and documented in each B2B contract agreement. B2B contract terms may differ from consumer job terms.

All payments on the Platform are processed by PayFast (Pty) Ltd, an independent South African payment service provider. HALA MOVE is not a payment service provider and is not liable for payment failures, holds, or delays caused by PayFast or by your financial institution. PayFast’s terms of service apply to payment processing.

HALA MOVE reserves the right to change the Platform Fee upon 30 days’ written notice. Changes to the Platform Fee do not affect Jobs that have already been accepted at the time of the notice.

Liability Limitations

HALA MOVE’s aggregate liability

HALA MOVE’s total liability to you in connection with any single incident or series of related incidents is limited to the value of the Job or Jobs directly affected by that incident. In no event will HALA MOVE’s liability exceed the total Platform Fees paid by you in the 3-month period preceding the claim.

Consequential loss

HALA MOVE is not liable for any indirect, special, incidental, or consequential loss or damage arising from your use of the Platform, including loss of profit, loss of business, or reputational damage, unless such consequential liability is explicitly included in a separately signed agreement.

Driver vehicle and goods liability

Each Driver maintains their own vehicle insurance. HALA MOVE’s verification of a Driver’s roadworthy certificate confirms vehicle condition at the time of verification it does not constitute HALA MOVE assuming liability for vehicle damage or third-party vehicle incidents during Jobs. Goods in transit insurance is available as an optional add-on for Customers and is subject to the terms of the applicable insurance policy.

PayFast independence

HALA MOVE is not liable for payment processing failures, delays, or holds caused by PayFast or by the Customer’s or Driver’s financial institution. All claims relating to payment processing must be directed to PayFast in the first instance.

Prohibited Uses

You may not use the Platform for any of the following purposes:

  • Arranging or accepting payment for Platform jobs outside the Platform (“off-platform transactions”)
  • Submitting fraudulent job postings, false Bids, or false delivery confirmations
  • Impersonating another User, Driver, or HALA MOVE representative
  • Transporting goods that are illegal, prohibited, or restricted under South African law, including but not limited to controlled substances, unlicensed firearms and ammunition, counterfeit goods, and stolen property
  • Circumventing or manipulating the rating system
  • Using automated scripts, bots, or other automated means to interact with the Platform
  • Sub-contracting Jobs to Drivers who are not registered and verified on the Platform
  • Using the Platform for passenger transport of any kind
  • Collecting, storing, or misusing other Users’ personal information

Prohibited and Excluded Goods

The following categories of goods may not be transported through the Platform under any circumstances. Customers who misrepresent the nature of goods to bypass these exclusions are in material breach of these Terms and may face immediate Account suspension and liability for any resulting loss or damage.

  • HAZCHEM and dangerous goods — goods classified as hazardous under the South African National Road Traffic Act 93 of 1996, SANS 10228, ADR regulations, or any applicable dangerous goods legislation. This prohibition does not apply where the Driver holds a current HAZCHEM transport certificate appropriate to the goods classification and the Customer has provided a Material Safety Data Sheet prior to booking.
  • Live animals — any live animal, unless accompanied by valid transport permits required under the Animals Protection Act 71 of 1962, the NSPCA guidelines, and any applicable provincial legislation. HALA MOVE does not represent that any Driver is equipped or trained to transport live animals.
  • Oversized and overweight loads — any load that exceeds the registered Gross Vehicle Mass (GVM) of the booked vehicle, or any load that cannot be safely contained and secured within the vehicle’s load area without extending beyond the vehicle’s legal load dimensions under the National Road Traffic Act.
  • Human remains — the transport of human remains requires a licensed funeral undertaker and applicable permits under the Births and Deaths Registration Act. This service cannot be facilitated through the Platform.
  • Temperature-controlled perishables — goods requiring refrigeration or certified temperature-controlled storage during transit. Standard HALA MOVE vehicles are not refrigerated. Such goods may only be transported if the Driver’s vehicle has certified refrigeration and this is confirmed in writing before booking.
  • High-value goods above R50,000 — cash, uncut gemstones, gold or platinum bullion, fine art, jewellery, or items with a declared or estimated replacement value exceeding R50,000, without prior written authorisation from HALA MOVE and written evidence of the Customer’s goods-in-transit insurance policy covering the items at their stated value.

Suspension & Termination

HALA MOVE may suspend or terminate your Account at any time, with or without notice, if you breach these Terms, the Driver Agreement, or any applicable law; if you engage in behaviour that harms other Users, the Platform, or HALA MOVE’s reputation; or if your Account is dormant for an extended period.

Where practical, HALA MOVE will provide notice and an opportunity to respond before permanent termination. Immediate suspension without prior notice may occur where fraud, safety risks, or serious misconduct is identified.

Upon termination, your right to use the Platform ceases immediately. Any outstanding payout for Jobs completed and confirmed before the date of termination will be processed and paid. HALA MOVE’s rights to use Job-related content (photos, ratings, reviews) as set out in the Intellectual Property clause below survive termination.

You may close your Account at any time by contacting hello@halaapp.co.za.

Intellectual Property

All intellectual property in the HALA MOVE Platform, including the software, design, brand, trademarks, and content, is owned by HALA MOVE (Pty) Ltd or licensed to HALA MOVE. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without HALA MOVE’s prior written consent.

By using the Platform, you grant HALA MOVE a non-exclusive, royalty-free, worldwide licence to use, store, display, and process Job-related content you generate on the Platform, including photographs, ratings, and reviews. This licence is used solely for the purpose of operating and improving the Platform. You retain ownership of this content.

Dispute Resolution

If you have a dispute with another User arising from a Job, you must first raise it through the HALA MOVE in-app support function. HALA MOVE’s dispute team will investigate using available evidence (GPS data, photos, status logs, chat history) and issue a finding within 24 business hours of the dispute being raised.

If you contest HALA MOVE’s finding, you may escalate to a senior resolution officer within a further 24 business hours. HALA MOVE’s escalated decisions are final under these Terms, subject to the right of either party to refer unresolved disputes to an independent arbitrator or to the appropriate South African court.

Any legal proceedings arising from these Terms that cannot be resolved through the dispute process will be subject to the exclusive jurisdiction of the South African courts in Durban, KwaZulu-Natal.

Governing Law

These Terms are governed by the laws of the Republic of South Africa. Where applicable, the following legislation applies to your use of the Platform:

  • Consumer Protection Act 68 of 2008
  • Electronic Communications and Transactions Act 25 of 2002
  • Protection of Personal Information Act 4 of 2013 (POPIA)

Changes to Terms

HALA MOVE reserves the right to update these Terms at any time. For material changes, we will provide at least 30 days’ notice by in-app notification and by posting a prominent notice on halaapp.co.za before the changes take effect.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must close your Account and stop using the Platform.

These Terms were last updated in April 2026.
